第一章 总则7 k# ?5 C! i0 k, L) i
第一条 为进一步完善我区风能资源开发利用管理体制,实现风电产业统筹规划、分步实施、有序发展的目标,根据《中华人民共和国可再生能源法》,结合自治区实际,特制定本办法。
% u, d/ w$ W3 N* N第二条 本办法所称风能资源开发利用管理主要包括风能资源勘查测量、风电发展规划、风能资源详查、项目开发利用、预可行性研究、可行性研究等工作。
, B) `2 \/ `( z5 U第三条 风能资源开发利用管理实行行政分级管理和技术归口管理制度。各级发展改革委是全区风能资源开发利用的行政主管部门。8 o' I0 ~, c" {# l
凡在自治区行政区域内从事风能资源开发利用的单位和个人,必须遵守本办法。6 p7 O" O5 y' r
第二章 风能资源管理$ g( @% H- b/ f# M9 g
第四条 自治区将风能资源的开发利用列为能源发展的优先领域,积极推动风能资源市场的建立和有序发展。鼓励各种所有制经济主体投资风能资源的开发和建设,依法保护投资者的合法权益。
7 ^6 E' p* T( k$ _! l第五条 风能资源勘查。自治区风能资源勘查分普查和详查两个阶段。
& }% G0 n0 P9 J+ a8 `风能资源普查。国家发展改革委和自治区人民政府共同出资,自治区发展改革委委托内蒙古气象科研部门按照有关规定开展区内风能资源普查及评价工作,内蒙古气象科研部门向自治区发展改革委提交区内风能资源普查评价成果。普查及评价成果将作为编制自治区风电发展规划的依据。
' f2 I$ [ G+ p6 B2 R. t# p, [9 r风能资源详查。风电项目法人根据自治区人民政府批准的风电发展规划,按照有关技术规范开展风能资源详查和项目开发利用工作,详查成果应作为编制预可行性研究报告和可行性研究报告的依据。4 r' [5 a& a2 S- H$ l5 B9 p
第六条 风能资源配置。自治区风能资源配置实行行政分级管理制度。# H3 e, c: R; f S
按照分级管理的原则,对于自治区风电发展规划内风能资源丰富区(Ⅰ级)、较丰富区(Ⅱ级)和可利用区(Ⅲ级),由自治区发展改革委依照有关法律法规对风能资源详查和项目开发利用进行管理;风能资源欠缺区(Ⅳ级),由盟市发展改革委依照有关法律法规对风能资源详查和项目开发利用进行管理。
/ [$ g* ?( M" T% L+ r3 X第七条 风能资源优先配置原则。在合理、有序、公平竞争的原则下,优先对在我区制造和组装风力发电设备的企业配置风能资源;优先对风电项目配套建设火电项目的企业配置风能资源;优先对直接向区外销售风电的企业配置风能资源。
% V9 S O E1 _# R8 r# Q" N第八条 风能资源测量方法应严格按照相关的国家标准执行。风能资源测量设备要符合国家有关技术、计量标准。6 x! K2 e4 Z. a5 _
第九条 风能资源的开发利用应符合环保、气象、林业等方面的法律法规。

第十条 为保证自治区风电产业健康、快速发展,促进能源结构调整,转变经济增长方式,实现可持续发展,制定符合自治区风电产业发展需要的风电发展规划。7 @* e2 T2 `+ j+ V, j
第十一条 全区风电发展规划由自治区发展改革委负责编制,经自治区人民政府批准后实施。8 E' z6 X7 p) Y/ B8 e+ v
第十二条 各盟市发展改革委负责编制本地区风能资源欠缺区(Ⅳ级)的风电发展规划,经自治区发展改革委批准后实施。; I# x& y0 o1 X+ x
第十三条 自治区发展改革委负责百万千瓦级风电场规划的前期工作,积极主动做好与国家发展改革委的衔接和上报工作,争取国家在我区建设百万千瓦级风电基地。( x) t" }6 c8 V1 y' j- x2 }
第四章 风电项目管理
; X* M# [" o! Y第十四条 风电项目预可行性研究和可行性研究工作。项目法人开展风能资源详查和项目开发利用,应按照国家有关规定开展预可行性研究和可行性研究工作,此项工作是自治区发展改革委核准和上报风电项目的依据。. b6 y1 s+ c! j' n; K4 q' F% ^
第十五条 风电项目预可行性研究报告和可行性研究报告必须由有甲级资质的单位进行编制。
S, v B* M! `) N第十六条 拟按照招投标确定项目法人的风电项目和百万千瓦级风电项目,必须编制预可行性研究报告,其中,百万千瓦级风电项目的预可行性研究工作由国家发展改革委负责管理。
3 V! [) @: B' v除本款规定的项目外,其他项目直接编制可行性研究报告。+ w8 @( M$ l$ ]* _9 @) E% _
第十七条 根据国家投融资体制改革有关规定,风电项目实行核准制。5万千瓦及以上的并网风电项目由自治区发展改革委上报国家发展改革委核准;5万千瓦以下的并网风电项目由自治区发展改革委核准。
+ y) n7 ^' Z0 i/ O) W d' ~/ ?; Q8 }第十八条 项目法人上报风电项目时,应按照《国务院关于投资体制改革的决定》(国发〔2004〕20号)、国家发展改革委《企业投资项目核准暂行办法》和《风电场工程建设用地和环境保护管理暂行办法》有关规定,提供相关支持性文件。6 x/ q* d- y1 J8 T" o
第十九条 自治区发展改革委应按照《企业投资项目核准暂行办法》有关规定,在受理项目申请报告后20个工作日内,做出对项目申请报告是否核准的决定或向上级项目核准机关提出审核意见。
% J$ n4 M6 z/ l) c4 [第二十条 项目建设要采取有效的安全生产措施和环保措施,严格履行项目基本建设程序,同时建立项目进展情况月报制度,每月上旬报自治区发展改革委备案。
, l9 O% g+ ~; H+ T) I2 L" {! o第二十一条 项目竣工后,项目法人或项目法人委托监理单位组织设计、施工等单位进行初步验收,并向自治区发展改革委提出竣工验收报告。同时,要做好整理技术资料、绘制竣工图和编制竣工决算报告等工作,报有关部门审查后,自治区发展改革委负责组织有关单位进行项目的全面验收工作。

Chapter I General Provisions& E" W+ j1 W& @' v4 d9 I1 R
Article 1 To further improve the system of development and utilization management of wind energy resources of this Region and realize the goal of overall planning, stepped implementation and orderly development of the wind power industry, these Measures are formulated in accordance with the Law of the People’s Republic of China on Renewable Energy Resources and in light of the actual situations of this Region.
$ O l+ e7 n# ^Article 2 For the purpose of these Measures, the term “development and utilization management of wind energy resources” mainly includes the survey and measurement of wind energy resources, wind power development planning, detailed wind energy resources survey, project development and utilization, pre-feasibility study, feasibility study, etc. - ]& N" y/ d( i: Z+ k% J4 X
Article 3 The development and utilization management of wind energy resources shall be subject to the hierarchical administrative management and centralized technical management. The development and reform commissions at various levels shall be the competent administrative departments of the development and utilization of wind energy resources across the region. ! u# T6 R; {& P& \, R4 y) o& y" |: L
All entities and individuals engaging in the development and utilization of wind energy resources in the administrative area of this Region must observe these Measures.
) U% @2 a {: ?% a$ IChapter II Wind Energy Resources Management
7 `; T2 v4 Q! R) J" W& B6 D p4 `Article 4 This Region shall give priority to the development and utilization of wind energy resources in the energy development, and make vigorous efforts for the establishment and orderly development of the wind energy resources market. This Region shall encourage the economic players of various ownership systems to make investment in the development and utilization of wind energy resources, and protect the legitimate rights and interests of investors. $ }8 N- ?0 j {8 E; a5 V
Article 5 Wind energy resources survey: The wind energy resources survey in this Region includes two phases, namely, general survey and detailed survey.. d3 c( B& g+ K! e
General survey of wind energy resources: The general survey and evaluation of wind energy resources within this Region shall be jointly funded by the National Development and Reform Commission (NDRC) and the People’s Government of this Region and conducted by the Meteorology Research and Development Department of Inner Mongolia as authorized by the Development and Reform Commission of this Region to which the Meteorology Research and Development Department of Inner Mongolia shall submit the results of the general survey and evaluation of this Region. Such results shall serve as a basis for making the wind power development planning of this Region. ' L( s5 G: P3 g5 b2 J5 e. Y
Detailed survey of wind energy resources: The wind power project entities shall carry out the detailed survey of wind energy resources and the project development and utilization work under the relevant technical norms according to the wind power development planning approved by the People’s Government of this Region, and the results of the detailed survey shall serve as a basis for making the pre-feasibility study report and the feasibility study report.
* B1 r* ~0 M4 |Article 6 Wind energy resources allocation: The wind energy resources allocation in this Region shall be subject to the hierarchical administrative management.

I kUnder the principles of hierarchical administration, in areas with abundant wind energy resources (Grade I), areas with less abundant wind energy resources (Grade II) and areas with utilizable wind energy resources (Grade III) that fall under the wind power development planning of this Region, the detailed survey of wind energy resources and the project development and utilization work shall be under the administration of the Development and Reform Commission of this Region according to the relevant laws and regulations; in areas with deficient wind energy resources (Grade IV), the detailed survey of wind energy resources and the project development and utilization work shall be under the administration of the development and reform commissions of leagues or cities according to the relevant laws and regulations.
- q' K) W/ i% a; n6 dArticle 7 Priority Principle for Wind energy resources allocation: Under the principle of rational, orderly and fair competition, in the wind energy resources allocation, priority shall be given to enterprises which manufacture and assemble wind power generating equipment in this Region, enterprises which construct thermal power projects in support of wind power projects and enterprises which directly sell wind power to areas outside this Region.
, M" O8 u W4 q) J; FArticle 9 Wind energy resources shall be developed and utilized in accordance with the laws and regulations on environmental protection, meteorology, forestry, etc. ..... |
